This Privacy Policy outlines the manner in which you and, where applicable, your child’s information is collected, utilized, and shared by POWERUP through the mobile application named POWERUP 4.0 (the “Application”), toys managed by the Application (the “Toy(s)”), and the services provided via our Application and the Toy (collectively referred to as the “Services”). This Policy does not extend to websites, applications, or services that are governed by different privacy policies. For topics not addressed by this Policy, the Main POWERUP Privacy Policy applies.

Data Collection:

• Personal Information: Includes Identity Data, Contact Data, Sensor Data, Mobile Data, and Toy Data.
• Provided by You When Configuring the Toy:
  • Identity Data: Age, your name (Optional), profile image (Optional) and user name (Optional)  All can be deleted or changed at any time.
  • Contact Data: Your email address only If over 13 or as per local laws. 
  • Sensor Data: Usage of specific Application features may require access to your device's camera, or location data.

Data Automatically Collected Through Technology:

• Mobile Data: Type of mobile device and software version if you download our Application.
• Toy Data: Bluetooth-enabled data transmission from the Toy to the Application, such as Toy identifier, connection times, non-personal diagnostic data on Application use, MAC Address or device identifier, accelerometer data, application crashes, etc.

Usage of Your Data:

• Identity Data: Used to comply with privacy laws, especially to determine if the user is a child under local laws. Profile image and user name used for leader boards and social features.
• Contact Data: Used for creating a user account designed for saving user, sensor and toy data. Additionally used for promotional marketing if consented to receive such communications.
• Sensor Data: Used to enhance Application features and user experience.
• Mobile and Toy Data: Employed for improving our Application and Toys, creating personalized experiences, understanding user engagement, and ensuring security of personal information.

Legitimate Interests:

• Developing and maintaining innovative Toys and Applications.
• Ensuring the security of our platform and protecting data.

Service Companies:

• Third-party companies assist in hosting the Application and Services, direct marketing, data analysis, and enhancing business operations. We ensure these companies adhere to our privacy standards.

Direct Marketing:

• Utilizes third-party services like Klavio for email marketing, provided you have given your consent
